Creighton Comp Hosting provides web hosting, VPS/dedicated server access, domain-related services, managed services, and technical support. Services may change, be upgraded, limited, or discontinued at any time.

3. Acceptable Use Policy (AUP)
You may NOT use our Services to engage in, support, or promote activities that are illegal, abusive, or harmful.
Prohibited Uses Include (but are not limited to):

Violations of local, state, federal, or international law

Hosting or distributing copyrighted material without authorization

Child exploitation or abuse material (zero tolerance)

Fraud, scams, phishing, or identity theft
3.2 Abuse & Network Misuse

Distributed Denial of Service (DDoS) attacks

Port scanning, vulnerability probing, or hacking attempts

Malware, ransomware, spyware, or botnet activity
-
Excessive resource usage that disrupts other customers
3.3 Email & Messaging Abuse

Spam, bulk unsolicited email, or SMS abuse

Use of purchased lists or harvested addresses
-
Operating open mail relays or proxies
3.4 Content Restrictions

Content that is defamatory, threatening, or harassing

Hate speech or incitement to violence
-
Content intended to exploit or deceive users
We reserve the right to determine what constitutes a violation.
4. Resource Usage & Fair Use
All Services are subject to reasonable and fair use limits. Excessive CPU, RAM, disk I/O, bandwidth, or network usage may result in:

Suspension of services

Required upgrade to a higher-tier plan
5. Backups & Data Responsibility
While we may offer backup services, you are solely responsible for maintaining your own backups. We are not liable for:

6. Payments, Billing & Refunds

All fees are due in advance unless otherwise stated

Failure to pay may result in suspension or termination

Setup fees, labor, hosting services, subscriptions, and domain registrations are non-refundable

NO REFUNDS are provided for any Services, including but not limited to hosting, VPS, dedicated servers, managed services, renewals, upgrades, or partial billing periods

Cancellations do not entitle you to any refund or credit
Chargebacks or payment disputes may result in immediate account suspension or termination.
7. Suspension & Termination
We may suspend or terminate Services immediately if:

You violate this TOS or AUP

Your use poses a risk to our network or others

Required by law or legal request
Termination does not relieve you of outstanding payment obligations.
8. Limitation of Liability
To the maximum extent permitted by law:

Services are provided "AS IS" and "AS AVAILABLE"

We disclaim all warranties, express or implied

We are not liable for indirect, incidental, or consequential damages

Our total liability shall not exceed the amount paid for Services in the prior 30 days

You agree to indemnify and hold harmless Creighton Computer Services LLC, its owners, employees, and partners from any claims arising from:

10. Privacy
Use of our Services is also governed by our Privacy Policy. We respect user privacy and will only disclose information as required by law or to protect our rights.
11. Changes to Terms
We may update these terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised terms.
12. Governing Law
These terms are governed by the laws of the State of Missouri, United States, without regard to conflict of law principles.
